Terms of Service

Guidion provides a downloadable application that allows users to:

Capture screenshots and create documents quickly and easily.

The App operates primarily locally on your device, with limited connections to third-party services for authentication and billing.

To use certain features, you must create an account through third-party providers.

• Authentication is handled by WorkOS
• Billing is handled by Lemon Squeezy

We do not directly store authentication credentials.

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account

4.1 Subscription Model

The Service is offered on a monthly subscription basis.

4.2 Payment Processing

All payments are processed through Lemon Squeezy, a third-party payment provider. Your use of their services is subject to their terms.

4.3 No Refunds

All payments are non-refundable. We do not provide refunds or credits for partial billing periods.

4.4 Failed Payments

If a payment fails:

• Your access to the Service may be immediately suspended or terminated

4.5 Cancellation

You may cancel your subscription at any time. Upon cancellation:

• You will retain access until the end of your billing period
• No further charges will be applied

5.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or internal business use.

5.2 Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Modify or create derivative works
• Circumvent licensing or subscription restrictions
• Use the Service in any unlawful manner

• Standard plans: Unlimited devices
• Pro plan: Limited to one (1) device per account

We reserve the right to enforce these limits.

We may suspend or terminate your account at any time, with or without notice, for any reason, including:

• Violation of these Terms
• Suspected abuse or misuse
• Non-payment

Upon termination:

• Your license to use the App is revoked
• Access to the Service may be disabled immediately

The Service integrates with third-party providers including:

• WorkOS (authentication)
• Lemon Squeezy (billing)

We are not responsible for the availability, performance, or policies of these third-party services.

9.1 Data Collection

We aim to minimize data collection. However:

• We use analytics and crash reporting tools
• Authentication and billing data are handled by third parties
• We do not directly store sensitive personal data such as passwords

9.2 Third-Party Data Handling

Any data processed by WorkOS or Lemon Squeezy is governed by their respective privacy policies.

We do not provide any uptime guarantees or service level agreements (SLAs).

THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT

We do not guarantee that:

• The Service will be uninterrupted or error-free
• The App will meet your requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• GUIDION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• THIS INCLUDES LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE LAST 12 MONTHS.

You agree to indemnify and hold harmless Guidion from any claims, damages, or liabilities arising from:

• Your use of the Service
• Your violation of these Terms

We reserve the right to:

• Modify or discontinue the Service at any time
• Change features, pricing, or functionality without notice

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles.

Any disputes shall be resolved in the courts located in Quebec.
